Examples of Bad Faith in Auto Insurance Disputes
- Failure to defend : If you are personally sued as the result of a car accident, your insurance company has a duty to hire a lawyer to defend you. Furthermore, the lawyer they choose must not put the insurance company’s interests above your own.
- Failure to settle: If a fair settlement offer is made by the plaintiff or their lawyers, your insurer may be obligated to protect you from further liability by accepting that settlement. The reason why is that if they refuse to settle and then lose at trial, you could be personally responsible for the amount of any jury award that exceeds your policy insurance limits.
- Unreasonable delays in the claims process: Even if you are not personally sued in connection with a motor vehicle accident, your insurer can still exercise bad faith by failing to investigate the accident in timely fashion, by dragging their feet in the claims process or by failing to indemnify your losses.
